EVILBAY LISCENSE AGREEMENT

Thank you for your interest in the EvilBay Developers Program, which allows you to build applications that use content from and interact with EvilBay-branded marketplaces around the super villain community. Even though we aren't really committed to protecting our users, we'd still like to keep our site and services in adequate conditions for destroying and taking over the world thus we require you to abide by the following terms governing your participation in the EvilBay Developers Program and your use of the EvilBay API, and this EvilBay Developers Program & API License Agreement. IF YOU DISAGREE WITH ANY TERMS OF THIS AGREEMENT, EVILBAY DOES NOT GRANT YOU A LISCENSE TO USE THE DEVELOPERS PROGRAM TOOLS OR THE API AND IF WE FIND OUT YOU DO WE WILL BE FORCED TO KILL YOU. If you reside anywhere on planet earth, your contract resides with EvilBay Inc. and if you reside in any other galaxy or universe, your contract still resides with EvilBay Inc. By accepting this agreement, you are representing and warranting that you have the authority (Under EvilBay Inc. of course) to bind the party being issued an Access Key (defined below) and you and that party are collectively referred to as "you" or "your" in this agreement.

1. DEFINITIONS

a. Access Keys means the not so confidential security keys provided by EvilBay to you for your use of the API including the developer ID, certificate ID, and application ID.
b. Application for all you morons means just what it says... the software application, website or other interface that you develop, own or operate to interact with the API.
c. Developers Program Tools means the EvilBay Application Programming Interface (API) and all other tools and information that should be available to you at the EvilBay developer's page which may never be put on the site.
d. EvilBay Content means all of the information stored in and retrieved from eVilBay databases. EvilBay Content does not include information that you obtain independent of EvilBay and API.
e. EvilBay Site means all of the following: www.EvilBay.com or any other website EvilBay decides to capture and control.
f. EvilBay User means anyone conniving enough to actually access any page on our EvilBay site.
g. EvilBay User Agreement means the terms and policies on which EvilBay fails to offer its services to the EvilBay Users, currently available through a dead link on the homepage of the EvilBay Sites.
h. Your Users means the imbeciles dumb enough to trust in your services, and anyone sublicense to your applications.

2. DEVELOPERS PROGRAM CONDITIONS
a. Participation in the eVilBay Developers Program. The EvilBay Developers Program is a set of APIs and tools that allows super villians to create Applications to access and/or interact with EvilBay content, sites and services.

b. Permitted Uses. Your use of the EvilBay Developer Program Tools is permitted only for the purpose of helping us in destroying all of planet earth and facilitating your own or your users' use of EvilBay's sites and services. Examples of intelligent uses of the tools would be as follows:

* Promote EvilBay by displaying EvilBay listings in your Application
* Allow EvilBay Users to search for and browse EvilBay listings with customized interfaces
* Allow EvilBay Users to bid on or buy items in EvilBay listings
* Allow EvilBay Users to administer My EvilBay
* Allow EvilBay Users to list items and manage their listings

c. Access Keys. EvilBay will provide you with Access Keys that permit you to access EvilBay's databases. The Access Keys are the property of EvilBay and we will revoke them whenever we feel like it, and if you violate any terms of this Agreement, or if EvilBay terminates this Agreement.

d. Certification. EvilBay will require Certification for all Applications. Certification will consist of confirmation by EvilBay or any independent super villian it designates. EvilBay holds only its users responsible for all costs associated with Certification and any modifications necessary to meet the Certification criteria and users will not be permitted to access the database until Certification is complete. If EvilBay requires Certification, failure by you to maintain certification means for termination of this agreement and leaves you at our mercy.

3. EVilBAY CONTENT
a. Authentication. Your application must enable your users to interact with EvilBay Sites and services once signed into their accounts (for example, bidding, buying or listing). This "Authentication" can occur only after EvilBay grants the application access to the EvilBay user's content through the consent page.
b. Age of Listings. Displayed items listing information may not be more than six hours older than the information displayed on the EvilBay site, and other EvilBay Content must be no more than twenty-four hours older than content displayed on the EvilBay Site. If your displayed item listing is not as current as your listing on the EvilBay Site , then your Application is terminated.
c. EvilBay Listings. If your application displays EvilBay listings for buyers to bid on or purchase, display all the minimum information that is legally required under applicable laws and regulations.
d. Information About Your Users. You can receive any personal information about Your Users either directly from Your Users or if you are willing to pay extremely large sums of money to the founders of EvilBay.
e. Information About Other EvilBay Users. You may receive information about other EvilBay Users, who may or may not be Your User that is publicly available from EvilBay or the EvilBay transaction providers. You are also able to collect, store, or dispose of other User's information because we don't really care, but we aren't liable for anything that happens to you.

4. EVILBAY POLICIES

You and your Application will comply with the EvilBay User Agreement and all applicable EvilBay Site policies or you will be shunned from the super villain community. In the event of a conflict between this Agreement and the EvilBay User Agreement regarding your use of the API, whatever EvilBay decides in their favor goes.

5. MODIFICATIONS

Since we aren't striving for User satisfaction, EvilBay has the right to change this Agreement whenever we feel it is necessary or just funny and EvilBay is not obligated to notify the super villain community.

6. MONITORING AND ENFORCEMENT

You agree that EvilBay has the right to monitor or audit your Application or activities relating to your activity on the site. If EvilBay believes that, you or your services breached this agreement we have the right to inflict any punishment we see fit and charge as many fees we want.

EvilBay Privacy Policy

This policy is supposed to tell you about how we use and protect your personal information, but we are not super heroes therefore we don't protect. This policy applies generally to the EvilBay.com website and content or any other websites we decide to capture.
